Terms of Use of the GovTech Ocean Website

This document (hereinafter the “Terms”) is a legally binding agreement between you (hereinafter the “User”) and the International Charitable Organization “East Europe Foundation”, a non-profit organization registered under the Unified State Register code 35142329, located at 55 Velyka Vasylkivska Street, 3rd floor, Kyiv, 03150 (hereinafter the “Foundation”).

These Terms govern the use of the GovTech Ocean website (hereinafter the “Website”), which is owned and administered by the Foundation within the framework of the Global Government Technology Centre in Kyiv (GGTC Kyiv) project.

Please read these Terms carefully before using the Website. By using the Website, you confirm that you have read, understood, and unconditionally accepted these Terms. If you do not agree with the Terms, please do not use the Website.

1. Definitions

  • Website – the GovTech Ocean online platform, available at govtechocean.org, which serves as a collection of all existing GovTech solutions in Ukraine, owned and administered by the East Europe Foundation under the GGTC Kyiv project.

  • User – any individual or legal entity that visits the Website and/or uses its functionality in accordance with these Terms.

  • Content – any materials, information, documents, texts, images, videos, software code, or other items posted on the Website by the Foundation or Users.

  • Personal Data – information or a set of information about an identified or identifiable natural person, processed in accordance with the Law of Ukraine “On Personal Data Protection.”

2. Purpose of the Website

GovTech Ocean is an open online platform for:

  • presenting GovTech solutions;

  • disseminating information about products, initiatives, and participants in the GovTech ecosystem;

  • providing access to analytics and materials in the field of GovTech.

The Website is not an e-commerce platform and does not provide commercial services.

3. Use of the Website

3.1. General Obligations

The User agrees to use the Website in good faith, solely for the purposes specified in Section 2 of these Terms, and in full compliance with applicable Ukrainian law and these Terms.

3.2. Prohibited Activities

The User is strictly prohibited from:

  • using the Website for any fraudulent, criminal, or otherwise illegal activities;

  • publishing, distributing, or otherwise disclosing information that is false, misleading, defamatory, offensive, discriminatory, or promotes hostility, violence, or terrorism;

  • interfering with the operation of the Website in any way, including unauthorized access to any parts of the Website, servers, or databases; modifying or reverse-engineering the Website’s code; distributing malware or initiating DDoS attacks;

  • collecting, storing, or distributing personal data of other Users without authorization;

  • posting Content that violates third-party intellectual property rights (copyrights, trademarks, etc.).

4. Intellectual Property

  • All rights to the Website’s design, texts, structure, logos, and source code belong to the Foundation or other rights holders and are protected under the Law of Ukraine “On Copyright and Related Rights.”

  • The Foundation grants Users a non-exclusive right to use Website materials solely for personal, non-commercial, and educational purposes, provided the source is properly cited.

  • Any other use of the Content is strictly prohibited without prior written consent from the Foundation.

5. User Content

  • The User bears full and sole responsibility for the accuracy, completeness, legality, and compliance of the Content they post on the Website.

  • By posting Content on the Website, the User grants the Foundation a non-exclusive, royalty-free, worldwide license to use, copy, reproduce, publish, distribute, and display such Content in any form for the purposes of operating the Website and other activities related to GovTech Ocean.

  • The Foundation does not pre-moderate User Content but reserves the right to remove or block any Content at its sole discretion if it violates these Terms or Ukrainian law, without prior notice to the User.

6. Liability

  • The Website and all its services are provided on an “as is” and “as available” basis. The Foundation does not guarantee uninterrupted or error-free operation.

  • The Foundation is not liable for any direct or indirect damages resulting from:

    • the use or inability to use the Website;

    • the accuracy, relevance, or completeness of information posted by Users;

    • following external links posted on the Website;

    • technical failures, interruptions, computer viruses, or other harmful software;

    • actions by third parties aimed at unauthorized interference with the Website.

7. Data Protection

The processing of personal data is carried out in accordance with the Privacy Policy.

8. Final Provisions

  • The Foundation reserves the right to amend these Terms unilaterally.

  • Amendments take effect upon publication of the new version on the Website.

  • Continued use of the Website after amendments constitutes the User’s full acceptance of such changes.

  • If any provision of these Terms is found invalid by a court, this shall not affect the validity of the remaining provisions.
